This User Agreement (“Agreement”) is a legally binding contract between you (“User”, “you”) and Write‑wise (“Company”, “we”, “us”, “our”), governing your access to and use of the Write‑wise website, applications, and related services (collectively, the “Service”). By accessing or using the Service, you confirm that you have read, understood, and agreed to be bound by this Agreement. If you do not agree, you must not use the Service.
1. Service Description
Write‑wise is an online language learning platform designed to help users improve their language skills through written exercises such as essays, dictations, and similar tasks. The Service analyzes user submissions using automated systems and provides feedback, evaluations, and improvement recommendations. The Service is provided for educational and informational purposes only.
2. Eligibility
You must be at least 18 years old or have reached the age of legal majority in your jurisdiction to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into this Agreement.
3. User Accounts
Some features may require account registration. You agree to provide accurate, complete, and current information and to keep your login credentials confidential. You are responsible for all activities conducted through your account.
4. Intellectual Property Rights
All content, software, algorithms, designs, trademarks, and materials provided by Write‑wise are owned by or licensed to the Company and are protected by applicable intellectual property laws. You are granted a limited, non‑exclusive, non‑transferable, revocable license to use the Service for personal, non‑commercial purposes only. No rights are granted except as expressly stated.
5. User Content and License
You retain ownership of the text and materials you submit to the Service (“User Content”). By submitting User Content, you grant Write‑wise a worldwide, royalty‑free, perpetual, irrevocable, sublicensable license to use, store, analyze, reproduce, modify, anonymize, and process such content for:
– Providing and improving the Service
– Training and improving language models and evaluation systems
– Generating aggregated statistics and insights
– Service performance analysis and internal research
– Marketing and promotional purposes using anonymized or aggregated data
Write‑wise will not sell identifiable User Content to third parties.
6. Data Usage and Privacy
By using the Service, you consent to the collection and processing of personal data and learning‑related data as described in our Privacy Policy. This includes performance metrics, progress indicators, and anonymized learning analytics used to improve the Service and demonstrate effectiveness in marketing materials.
7. No Guarantee of Results
Write‑wise does not guarantee any specific learning outcome, improvement, certification, or proficiency level. Progress depends on individual abilities, effort, consistency, and external factors. Feedback and evaluations are generated automatically and may contain inaccuracies.
8. Educational Disclaimer
The Service does not provide academic, professional, or certified language instruction. Feedback is informational only and should not be relied upon as professional or academic advice.
9. AI and Third-Party Services Disclaimer
The Service relies on automated systems and third-party artificial intelligence (AI) services, including large language model (LLM) providers, to analyze user submissions and generate feedback.
Write-wise does not develop, operate, or control the underlying AI models used by third-party providers and does not guarantee the accuracy, completeness, or suitability of AI-generated feedback. Output may contain errors, omissions, or inaccuracies.
User submissions may be transmitted to third-party AI providers in accordance with their standard terms and privacy policies. Write-wise does not control and is not responsible for how such providers further process submitted data beyond the functionality requested by the Service.
The Service is provided for educational and informational purposes only. Write-wise makes no guarantees regarding learning outcomes, progress, or results, which depend on individual effort, abilities, and external factors.
By using the Service, users acknowledge and accept the use of third-party AI services and assume all risks associated with reliance on AI-generated feedback.
10. Acceptable Use
You agree not to misuse the Service, including but not limited to:
– Violating laws or regulations
– Uploading unlawful, offensive, or infringing content
– Attempting to reverse engineer or exploit the Service
– Using the Service to compete with Write‑wise or for commercial redistribution
11. Suspension and Termination
This Agreement remains in effect for as long as you access or use the Service.
Write-wise reserves the right, at its sole discretion, to suspend, restrict, or terminate your access to the Service, in whole or in part, at any time and for any reason, including but not limited to technical, operational, legal, or economic reasons, or where the continued provision of the Service is no longer commercially or economically viable.
Write-wise may also discontinue, modify, or permanently shut down the Service, or any part thereof, with reasonable advance notice where practicable. The form and duration of such notice shall be determined by Write-wise and may be provided via the Service, email, or other reasonable means.
You acknowledge and agree that Write-wise shall not be liable for any damages, losses, or claims arising from or related to the suspension, termination, or discontinuation of the Service, including loss of access, data, progress, or expected benefits, except to the extent that such liability cannot be excluded under applicable law.
In the event of termination or discontinuation of the Service, Write-wise shall have no obligation to continue storing user content or data, except where retention is required by applicable law.
Termination of the Service shall not give rise to any right to compensation, indemnification, or damages, provided that mandatory consumer protection laws remain unaffected.
12. Service Availability
The Service is provided “as is” and “as available.” We do not guarantee uninterrupted or error‑free operation and may modify or discontinue features at any time.
13. Limitation of Liability
To the maximum extent permitted by law, Write‑wise shall not be liable for any indirect, incidental, consequential, or special damages arising from use of or inability to use the Service. Total liability shall not exceed the amount paid by you to Write‑wise during the preceding six months, or zero if no payment was made.
14. Indemnification
You agree to indemnify and hold harmless Write‑wise from any claims, damages, losses, or expenses arising from your use of the Service, your User Content, or violation of this Agreement.
15. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the European Union and, where applicable, the laws of the Company’s country of registration, without regard to conflict‑of‑law principles.
16. Changes to Agreement
We may update this Agreement from time to time. Continued use of the Service after changes constitutes acceptance of the revised Agreement.
